In these terms and conditions the Company means Fairycakes of Fulwell and the Customer means You, the person placing the order.
Terms of Agreement
A booking is made and a contract formed when the company receives a non-refundable £50 deposit from the customer, and we confirm the booking to you.
The confirmation should be checked by the customer and mistakes must be notified within 14 days. The remaining balance must be paid by 28 days before the event. If the balance is not paid by the due date, the company will be entitled to regard the booking as cancelled and no refund will be payable.
The company will not take responsibility for not reaching any venue due to road works, traffic chaos or any other highway hazard. Any variation on the terms and conditions can only be permitted if expressed in writing by the company.
Once the cake has been set-up at the venue, the customer agrees to take responsibility for it, and any claim for damage caused to the surrounding furnishings, or the injury of any persons, or damage to their clothing in the event of the cake, or its decoration being knocked over.
The company requests that the customer makes their guests aware that the company cannot guarantee that the cake or any of its decoration has not come into contact with nuts, nut products, or alcohol. Although the icing and the petals and leaves of the sugar flowers are edible, all other decorations are not (this includes wires, ribbons, pins, jewels, boards etc) and the company will take no responsibility for any problems or incidents which may occur from this.
The customer must make all cancellations in writing. All deposits are non-refundable. If a booking is cancelled between 28 and 14 days before the event, the company will refund 50% of the cost. Cancellations made between 14 days and the day of the event, the company will refund 10%.
If the company is in default of any of its obligations hereunder it shall not be liable, where default is due to majure, war strike, lockout, industrial action, fire flood, drought, illness or any other event beyond the reasonable control of the company. In these circumstances the company shall give notice to the customer where possible and be released from performance obligations.
These conditions are subject to English Law and the customer consents to the exclusive jurisdiction of the English courts in all matters regarding these services.
